Terms of Use

1. Introduction: Scope & Definitions
These terms and conditions, together with any documents they expressly incorporate by reference (collectively, these “Terms of Use”), govern your use of and access to flocks.digital and all its subdomains (www.flocks.digital, app.flocks.digital,…), including any content and functionality (referred to as “Digital Channels”), whether as a visitor or registered user . Please read these Terms of Use carefully before using these Digital Channels in any way.
By visiting, creating an account or using our Digital Channels in any other way, you expressly acknowledge your acceptance of and agree to be legally bound by the Terms of Use. If you do not want to agree to these Terms of Use, you must not access or use our Digital Channels.
These Terms of Use are entered into by and between You and Integr8 Consulting B.V. (”Company”, “we”, “our” or “us”), a company incorporated under Belgian law with company registration number BE0867.080.426, having its registered office at Fortweg 2, 2500 Lier, Belgium. Flocks.digital is a registered trademark of Integr8 Consulting BV.
2. Purpose and content
Our Digital Channels provide information about our services and enables interaction with our Company, such as contacting us for additional information, pitching ideas, sharing job opportunities for new joint business ventures, etc…
3. Contact & Complaints
For general inquiries and all notices of what you believe are violations of your rights (including intellectual property rights), you may contact us at contact@flocks.digital.
For legal notices or service of process, you may write us at the address mentioned in section 1.
4. Eligibility and Dos
To use our Digital Channels, you agree that: (1) you have reached the age of 18 years old or older; (2) you will only have one account, which must be in your real name; and (3) you are not already restricted from using our Digital Channels. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 18.
You agree that you will:
- comply with all applicable laws or with any specific legal or other rules that are applicable to you;
- provide accurate, current, and complete information and to comply with our Privacy Policy regarding the use and management of your information.
5. Don’ts
You agree not to:
- breach or circumvent any laws, third-party rights or our systems, policies, or instructions regarding the use of our Digital Channels;
- create a false identity, misrepresent your identity, create an account for anyone other than yourself (a real person), or attempt to use another person’s account;
- copy, scrape or monitor any data on the Digital Channels using any manual process or automated means (including but not limited to scripts, robots, spiders, crawlers, browser plugins, add-ons or other technologies);
- circumvent, bypass, or override any technical measures, security features, access controls, or usage limits of the Website, or attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Website, its servers, or any connected servers, computers, or databases;
- test or exploit any vulnerabilities of the Digital Channels;
- post, share, or introduce any software viruses, worms, trojan horses, logic bombs, or other malicious or technologically harmful code or material;
- harvest, collect, copy, use, display, distribute, or otherwise obtain any information (including content) from the Digital Channels without the prior consent of the information owner;
- disclose information that you do not have the consent to disclose, such as personal or confidential information of others;
- violate the intellectual property rights of any person or entity (such as Company), including copyrights, patents, trademarks, trade secrets or other rights;
- reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Digital Channels or any related technology;
- deep-link to our Digital Channels without our consent for a purpose that is not specified in these Terms of use;
- mirror, frame, overlay, or otherwise simulate or modify the appearance or function of our Digital Channels;
- interfere with the operation or proper functioning of the Digital Channels or place an unreasonable load on it (e.g., spam, denial-of-service attacks, or viruses), using any device, software, routine or otherwise to disrupt its functionality, impairing others’ ability to use the Digital Channels;
- use our Digital Channels to do anything that is unlawful, misleading, discriminatory, or fraudulent.
You agree not to post or share content that:
- is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise inappropriate;
- contains or promotes sexually explicit material, pornography, violence, or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
- infringes on intellectual property rights, including patents, trademarks, copyrights, trade secrets, or any other proprietary rights;
- violates the legal rights of others, such as privacy or publicity rights, or could result in civil or criminal liability under applicable laws or conflict with these Terms of Use or our Privacy Policy;
- is misleading or intended to deceive others;
- incourages illegal activities or supports, promotes, or facilitates unlawful acts;
- causes unnecessary distress or annoyance, or is likely to offend, alarm, embarrass, or upset others;
- impersonates another person or misrepresents your identity or connection with any individual or organization;
- involves commercial promotions such as contests, sweepstakes, advertising, or bartering
- falsely suggests it is provided, endorsed, or approved by us or any other individual or organization.
6. Availability
We reserve the right to amend, suspend, discontinue or limit (e.g. by country) any or all of the features, content and other information on our Digital Channels, in our sole discretion without notice.
We do not guarantee the functionality or availability of the Digital Channels and cannot be held liable for any malfunctions, temporary or prolonged unavailability, or any direct or indirect damages arising from your access to or use of the Digital Channels. Access to some parts or the entirety of the Digital Channels, including for registered users, may be restricted at any time and for any reason.
Our Digital Channels are not a storage service and we don’t promise to store or show (or keep showing) any information (including content) that you’ve shared. You agree that we have no obligation to store, maintain or provide you a copy of any content or other information that you or others provide, except to the extent required by applicable law and as noted in our Privacy Policy.
7. Geographic Restrictions
The owner of the Digital Channels is based in Belgium. Access to the Digital Channels as a registered user is not allowed outside Belgium, which is actively enforced by verifying the country extension of your mobile phone number. If you access the Digital Channels as an anonymous user from outside Belgium, you do so on your own initiative and are responsible for compliance with local laws.
8. No Warranty
YOUR USE OF THE DIGITAL CHANNELS AND ITS CONTENT IS AT YOUR OWN RISK. THE DIGITAL CHANNELS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OF DATA, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
9. Exclusion of Liability
The Digital Channels may include content provided by third parties, including registered users. All opinions and/or statements expressed in that content, such as elevator pitches and job opportunities, or other materials, are solely the responsibility of the person or entity providing it and does not necessarily reflect the opinion of the Company. By using the Digital Channels, you acknowledge that you may encounter content that is inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. Any reliance you place on such information is strictly at your own risk. We are not responsible or liable for the content, accuracy, or legality of any materials or information provided by third parties, including registered users.
Our digital channels may help you connect with other registered users who may present you with opportunities, such as offers to collaborate on new business ventures or job openings. You acknowledge that this does not entail any obligation on the part of Company to fulfill these opportunities.
Despite all efforts, our Digital Channels can never be free from all potential security risks. We do not have any direct or indirect, general or special liability for any direct or indirect damages arising from the use of the Digital Channels, in particular from the use of links or hyperlinks, files available for downloading from the internet or the Digital Channels, including, without limitation, provision of incorrect information, any losses, business interruptions, damage to the user’s programs or to any other data on the user’s computer system, to the user’s devices, software or other damages. We are not responsible for any violation of user data confidentiality, for instance when the Digital Channel servers are attacked by third parties.
The Digital Channels may include hyperlinks that lead or indirectly refer to websites or web pages owned by third parties. The placement of links to such websites or pages does not in any way imply approval of their contents. Company hereby expressly states that it has no control over the content or other characteristics of said websites and declines all and any liability for their content or characteristics or for any other form of loss or damage arising from the use thereof. Company also makes reference to these websites’ own Terms of Use.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, ITS EMPLOYEES, OFFICERS, AND DIRECTORS SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE DIGITAL CHANNELS, ANY CONTENT ON THE DIGITAL CHANNELS, OR ANY LINKED WEBSITES. THIS INCLUDES, BUT IS NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, SUCH AS PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, PROFITS, BUSINESS OPPORTUNITIES, ANTICIPATED SAVINGS, GOODWILL, DATA, OR REPUTATION, AS WELL AS SERVICE INTERRUPTIONS OR UNAUTHORIZED USE OF THE DIGITAL CHANNELS.
THE COMPANY PROVIDES THE DIGITAL CHANNELS FOR USERS TO INTERACT WITH EACH OTHER AND/OR THE COMPANY AND IS NOT RESPONSIBLE FOR CONTENT OR INFORMATION SHARED BY THOSE USERS. THE COMPANY WILL NOT BE LIABLE FOR ANY CLAIMS, DAMAGES, EXPENSES, OR COSTS RELATED TO UNAUTHORIZED OR UNLAWFUL USE OF THE DIGITAL CHANNELS, NOR FOR ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
REGARDLESS OF THE PREVIOUS PARAGRAPHS, IF COMPANY WOULD BE FOUND LIABLE, OUR LIABILITY TO YOU OR TO ANY THIRD PARTY IS LIMITED TO 1.000,00 EUR.
10. Accounts
As a registered user or account holder, you agree to protect your account by keeping your password, and any other security information confidential. Your account is personal to you, and you must not share, transfer, or provide access to your account or any part of it to any other person or entity. You agree to use a strong password and to notify us immediately of any unauthorized access, use of your account, or any other security breach at contact@flocks.digital.
11. Confidentiality and data protection
All content you get access to by using your personal account will be considered strictly confidential. Public disclosure will only be allowed upon explicit consent of both Company and the content creator. You will be considered liable for all damage that can be attributed to a serious or repeated minor infringement of this confidentiality obligation.
You and Company agree that if content includes personal data, it is subject to our Privacy Policy. You and Company agree that we may access, store, process, and use any information (including content and/or personal data) that you provide in accordance with the terms of the Privacy Policy.
12. Intellectual Property
Company reserves all of its intellectual property rights in the Digital Channels, including, but not restricted to, the texts, logos, codes, interface elements, information, images, video and sound files.
You retain all of your ownership rights of the original content that you submit or post to the Digital Channels. You agree that we may collect analytical information about your content.
13. License
By providing content and other information to the Digital Channels, you grant Company a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to use, access, copy, modify, distribute, display, host and process that content and other information for the purpose of operating, promoting, and improving the Digital Channels.
You also grant each other user of the Digital Channels a worldwide, non-exclusive, royalty-free licence to access your Content through the Digital Channels, and to use, access and display it, only as enabled by a feature of the Digital Channels.
You can end this license for specific content by deleting such content from the Digital Channels, or generally by closing your account, except (a) to the extent you (1) we had already sublicensed others prior to your content removal or closing of your account, or (2) we are required by law to retain or share it with others, and (b) if the operation of the Digital Channels requires it or for the reasonable time it takes to remove from backup and other systems.
Any suggestions or other feedback you submit regarding our Digital Services are nonconfidential and can be used for any purpose without compensation to you by Company.
14. Changes
We may revise and update these Terms of Use from time to time in our sole discretion. The most current version of the Terms of Use will always be available at this page.
If we make significant changes that could substantially alter your obligations or if required by applicable law, we will provide registered users notice by email or by other means, to provide them the opportunity to review the changes before they become effective. Non-registered users are expected to check this page on a regular basis when they access the Digital Channels, so they are aware of any changes and for complying with the latest version.
If you object to any of these changes, you may close your account. Your continued use of our Digital Channels after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms as of their effective date.
15. Applicable law and competent court
Parties are committed to resolve disputes as much as possible in mutual consent.
All disputes arising from these Guidelines will be governed by Belgian law and will be submitted to the competent courts of Antwerp, section Antwerp.
16. Termination
If you wish to terminate this agreement at any time, you can do so by closing your account and no longer accessing or using our Digital Channels.
We reserve the right to suspend or terminate your account at our sole discretion and without prior notice. This may occur for any reason, including but not limited to violations of these Terms of Use or inappropriate or threatening behavior toward our employees (verbally or in writing).
We can also remove any content or other information you submitted via our Digital Channels if we believe it violates our Terms of Use.
The following sections of these Terms of Use shall survive termination: 5, 8, 9, 13, 15, 17.
17. General Terms
You may not assign or transfer these terms to anyone without our consent. However, you agree that Company may transfer or assign ownership of these terms to its affiliates or a party that buys it at any time without your consent.
If any provision of the Terms of Use are found by a court or tribunal of competent jurisdiction to be invalid, illegal or unenforceable, such provision shall be modified or limited to the minimum extent necessary to render it enforceable while preserving its intent and achieving as nearly as possible the same economic effect. If modification is not possible, the provision shall be deleted and the remaining provisions of the Terms of Use shall remain in full force and effect. Failure to enforce any provision or right under these Terms of Use shall not constitute a waiver of that right.
Not claiming of a right or not applying a sanction by Company shall in no way apply a waiver of rights.
The Terms of Use are the only agreement between us regarding the Digital Channels and supersede all prior agreements for the Digital Channels.
Regardless of the nature of and/or value of the legal act to be proven, each party can at all times prove this by means of the following additional evidence: copies or reproductions in any form whatsoever (photocopies, scans,…), via data carrier, fax, sms, logs, email etc. Such evidence has the same evidential value as a private deed drawn up in accordance with the provisions of the (Belgian) Civil Code.
